Probation Violation - The Consequences Once the court finds someone guilty of a crime, as a substitute for a jail sentence, the court has an option to suspend the sentence and place the defendant on probation. When this happens, instead of going to jail or a prison, the defendant remains free, but has to comply with the conditions of probation. The probation can be supervised or unsupervised. When the probation is unsupervised, the usual condition is that the defendant not be convicted of any crime during the period of probation. When the probation is supervised, the probation officer will supervise the person on probation to be sure that all of the conditions of probation are met.
